Terms of Service

1. Acceptance of terms

By accessing or using the Engitrack platform at https://engitrack.in (the “Platform”), or by engaging Engitrack for professional agency services (“Agency Services”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Platform or engage our Agency Services. These Terms form a legally binding agreement between you and Engitrack.

2. About Engitrack

Engitrack operates two distinct offerings under one trade name:

  • The Platform — a virtual internship platform that allows eligible students to apply for short-form internships in domains such as web development, digital marketing, and social media. Selected students receive a task brief, submit their work for review, and may purchase a verified digital certificate and Letter of Recommendation upon approval.
  • Agency Services — professional consulting and project work for business clients across web development, social media management, and digital marketing. Each engagement is governed by a separately signed Proposal or Statement of Work in addition to these Terms.

Applications to the internship program are free. Certificates carry a one-time fee disclosed at the time of purchase. Agency Services are priced and scoped per engagement.

3. Eligibility

  • You must be at least 18 years old to register a Platform account on your own.
  • Users between 13 and 17 may use the Platform only with verifiable parental consent.
  • You must provide accurate, current, and complete information during registration or while engaging Agency Services.
  • You must keep your account credentials confidential. You are responsible for all activity under your account.

4. Internship program

  • Applying for an internship is free and does not guarantee selection. We select applicants at our discretion based on the information provided.
  • If selected, you will be notified by email and given access to a task brief through your dashboard.
  • Submissions are one-shot: you can submit your work only once. Make sure your submission is complete before clicking Submit.
  • You retain ownership of the work you create. By submitting it, you grant Engitrack a non-exclusive, royalty-free, perpetual licence to display and reference it for verification and program-administration purposes.
  • Submissions must be your own work. Plagiarism, fraud, or use of someone else's identity will result in immediate disqualification and may invalidate any certificate already issued.

5. Certificate purchase

  • After your submission is approved, you may purchase a digital certificate and Letter of Recommendation at the price disclosed in your dashboard.
  • Payment is processed by Razorpay. We do not see or store your card details.
  • On successful payment, the certificate PDF is generated within seconds and made available for download. The Letter of Recommendation is included.
  • Each certificate has a unique ID and a publicly verifiable URL of the form /verify/<id>.
  • Refunds are governed by our Refund Policy.

6. Agency Services — engagement

  • Agency Services are offered across three practice areas: web development, social media management, and digital marketing.
  • Each engagement begins with a written Proposal or Statement of Work (the “Proposal”) that defines scope, deliverables, timeline, price, payment schedule, and any practice-specific terms. The Proposal is incorporated into these Terms by reference once signed by both parties.
  • If a clause in your signed Proposal conflicts with these Terms, the Proposal prevails for that engagement.
  • Work begins only after the Proposal is signed and the agreed advance is received.
  • Either party may terminate an engagement in writing at any time, subject to the payment and refund rules in section 7.

7. Agency Services — payment terms

One-off projects (typical for web development and most digital marketing campaigns):

  • 50% advance on Proposal signing. Work begins only after advance receipt.
  • 50% balance on delivery of the agreed scope.
  • If the client cancels mid-project, the advance is non-refundable. The client receives whatever work has been completed up to the cancellation date.
  • If Engitrack cancels mid-project, the client receives a prorated refund of the advance based on work not yet delivered, plus all work completed to date.
  • Larger or multi-phase engagements may use milestone-based billing as specified in the Proposal.

Ongoing retainers (typical for social media management and ongoing marketing):

  • Monthly retainer billed in advance.
  • Either party may end the arrangement with 30 days' written notice.
  • The notice-period month's retainer is non-refundable; service continues through the notice period.
  • Third-party ad spend (Google Ads, Meta Ads, etc.) is billed at cost and is separate from the retainer unless the Proposal states otherwise.

All payments are processed via Razorpay, bank transfer, or another method specified in your Proposal. Late payments may pause work and accrue interest at 1.5% per month, capped at the maximum rate permitted by Indian law.

8. Agency Services — deliverables and IP

  • Work product (the specific deliverables created for the client — code, designs, copy, campaign assets) transfers in full to the client on receipt of the final payment.
  • Reusable tooling — Engitrack retains all rights to internal frameworks, scripts, templates, methodologies, and know-how that exist before or are developed independently of the engagement. The client receives a perpetual, non-exclusive licence to use such tooling as embedded in their deliverables.
  • Third-party assets (fonts, stock images, code libraries) are licensed to the client under their respective licences. Engitrack will disclose these in the Proposal or on delivery.
  • Portfolio rights: unless the Proposal specifies otherwise, Engitrack may reference the engagement (client name, project description, public visuals) in its portfolio and marketing materials.
  • The client warrants that any content they provide (logos, copy, brand assets) does not infringe third-party rights and indemnifies Engitrack against any claim arising from such content.

9. Acceptable use

You agree not to:

  • Use the Platform or Agency Services for any unlawful purpose or in violation of any Indian or applicable foreign law.
  • Impersonate another person or misrepresent your identity, qualifications, or affiliation.
  • Submit content that infringes intellectual property, privacy, or other rights of third parties.
  • Submit content that is abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Attempt to access accounts, data, or systems you are not authorised to access; probe, scan, or test the vulnerability of the Platform; or interfere with its operation.
  • Use automated systems (bots, scrapers) to access the Platform without our prior written consent.
  • Resell, sublicense, or otherwise commercially exploit the Platform or any content obtained from it.
  • Forge, alter, or counterfeit certificates, or misrepresent the result of a verification check.
  • Use Agency Services to produce content that promotes hate speech, illegal products, gambling, or other content prohibited by Indian law.

10. Intellectual property

All Engitrack branding, page content, code, design system, and templates are owned by Engitrack and protected by Indian and international copyright and trademark law. You may not copy, modify, distribute, or create derivative works without our prior written consent, except for personal, non-commercial reference.

Your own internship submissions remain your property, subject to the licence granted in section 4. Agency-Service work product is governed by section 8.

11. Confidentiality

Where an Agency Services engagement involves access to non-public information from either party, both parties agree to treat that information as confidential and not disclose it to any third party except as required to perform the engagement or by law. This obligation survives the end of the engagement.

12. Certificate validity

Engitrack reserves the right to revoke a certificate if we discover, after issuance, that the underlying submission was plagiarised, fraudulent, or otherwise in breach of these Terms. A revoked certificate will be marked as invalid on its public verification page. No refund is due on revoked certificates.

13. Disclaimer of warranties

The Platform and Agency Services are provided “as is” and “as available”. We do not warrant that the Platform will be uninterrupted, error-free, or that defects will be corrected. We do not warrant that any internship will result in employment, academic credit, or any specific outcome. For Agency Services, we make no warranty as to specific business outcomes, traffic numbers, conversion rates, or revenue impact; results depend on factors outside our control. To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of liability

To the maximum extent permitted by applicable law, Engitrack's total liability to you for any claim arising out of or relating to these Terms, the Platform, or any Agency Services engagement shall not exceed the amount you paid us in the twelve months preceding the claim, or INR 1,000, whichever is higher. In no event shall we be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, data loss, or reputational harm, even if we have been advised of the possibility of such damages.

15. Indemnification

You agree to indemnify, defend, and hold harmless Engitrack from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the Platform, your engagement of Agency Services, your violation of these Terms, or your violation of any third-party right.

16. Termination

We may suspend or terminate your Platform account at any time, with or without notice, for breach of these Terms, fraud, abuse, or any conduct we determine in good faith to be harmful to other users, third parties, or the Platform. You may terminate your Platform account at any time by emailing support@engitrack.in. Termination of an Agency Services engagement is governed by section 7 and the signed Proposal. Termination does not entitle you to a refund of any fees already paid except as set out in our Refund Policy or the Proposal.

17. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms, the Platform, or an Agency Services engagement shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka. Before commencing any formal proceeding, the parties shall attempt to resolve the dispute in good faith by written notice to support@engitrack.in within 30 days.

18. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email to registered users and active Agency clients at least 30 days before they take effect. Continued use of the Platform or engagement of Agency Services after the effective date constitutes acceptance of the revised Terms.
